1. General
1.1 Seller. Thomas Dambo Art ApS, Salløvvej 3, DK-4621 Gadstrup, Denmark. CVR/VAT DK42497266. store@thomasdambo.com, +45 53 83 48 53
1.2 Scope. Part 2 applies to consumers, Part 3 to business customers, Part 4 to all. This includes orders shipped from our US warehouse.
1.3 Precedence. A signed agreement, such as a Merchandise License Agreement, prevails over these terms.
1.4 Version. The terms published at the time of order apply.
2. Consumers
2.1 Order. The contract is formed by our order confirmation. Orders with obvious price errors may be cancelled with a full refund.
2.2 Prices. EU shop prices include Danish VAT. US shop prices exclude sales tax, which is added at checkout. Shipping is shown before payment.
2.3 Payment. At checkout. Cards are charged on shipment.
2.4 Duties. Import duties and taxes outside the EU are paid by the customer unless stated otherwise at checkout.
2.5 Right of withdrawal (EU). 14 days from receipt, no reason needed. Notify us at store@thomasdambo.com and return the goods within 14 days of notice. You pay return shipping. We refund the price and standard shipping within 14 days of your notice but may wait until we receive the goods. Loss of value from handling beyond normal inspection may be deducted. Personalised and made-to-order goods are excluded.
2.6 Returns outside the EU. Unused goods may be returned within 30 days of receipt. You pay return shipping.
2.7 Defects. You have a 2-year right of complaint under Danish law. Contact store@thomasdambo.com with order number and a photo. We repair, replace or refund.
2.8 Disputes. Nævnenes Hus, Toldboden 2, DK-8800 Viborg, naevneneshus.dk.
3. Business customers
3.1 Orders. Binding on our written confirmation. Wholesale prices and minimum orders follow our current B2B price list.
3.2 Prices. Exclusive of VAT, duties and shipping. Prices may change on 30 days’ notice. Confirmed orders are not affected.
3.3 Payment. Net 30 days from invoice date unless otherwise agreed. Late payment accrues interest at 1.5% per month, a reminder fee of DKK 100 and statutory compensation of DKK 310. We may suspend deliveries while payments are overdue.
3.4 Retention of title. Goods remain our property until paid in full.
3.5 Delivery and risk. Ex works our warehouse unless otherwise agreed. Risk passes when goods are handed to the carrier.
3.6 Inspection. Inspect goods on receipt. Report defects or shortages in writing within 8 days of receipt, and hidden defects within 8 days of discovery, at the latest 12 months after delivery. We replace, credit or refund at our choice.
3.7 Liability. Limited to the invoiced value of the goods concerned. No liability for indirect loss, lost profit or lost sales. Product liability follows mandatory law.
3.8 Resale. Sale to consumers through your own physical or online shop only. Resale to other businesses or on marketplaces (Amazon, eBay, Etsy and similar) requires our written consent. Our product images may be used only to sell our products.
4. All customers
4.1 Copyright and trademarks. All artwork, troll characters, photos and website content, the name Thomas Dambo and our logos are protected by copyright and trademark law and belong to us. Buying a product gives no right to copy it, reproduce the artwork or make derivative products. Any other use requires our written consent.
4.2 Privacy. See our Privacy Policy.
4.3 Force majeure. We are not liable for delays or non-delivery caused by events beyond our control.
4.4 Law and venue. Danish law applies. Disputes go to the Danish courts, with Retten i Roskilde as first instance. Consumers keep any mandatory protection under the law of their country of residence.
